根據《香港終審法院條例》(第484章)第6(2)條,終審法院首席法官是司法機構之首,負責司法機構的行政管理。司法機構政務長負責就司法機構的行政管理向終審法院首席法官提供策略性支援。不論何時,司法機構政務處的首要工作是促進有利於司法機構及香港司法工作的事務。
具體來說,司法機構政務長需就以下範疇向終審法院首席法官負責:
(1) 就司法機構在香港特別行政區執行司法工作方面維護其獨立性;
(2) 向終審法院首席法官就司法機構的行政管理提供意見;
(3) 作為司法機構政務處之首:
(a) 確保法官在執行司法工作時獲提供適當支援;
(b) 對司法機構政務處轄下所有辦事處及組別施行適當管理,以確保司法機構運作暢順和各級法院的司法程序得以順利進行;
(c) 就提升執行司法工作質素方面制定政策、程序及常規;
(d) 確保財務、人事及辦公地方等資源得到妥善管理,以支援司法機構的有效管治;
(e) 與司法機構所有持份者(包括社會大眾)維持及建立合適而有效的溝通;
(f) 與其他司法管轄區的司法機關保持及建立交流;
(4) 作為與政府行政及立法機關的主要聯絡人;及
(5) 出任司法人員推薦委員會秘書;該委員會為法定組織,負責向行政長官作出司法人員任命推薦及相關事宜。
Under Section 6(2) of the Hong Kong Court of Final Appeal Ordinance (Cap. 484), the Chief Justice is the head of the Judiciary and is charged with the administration of the Judiciary. The JA is responsible for providing strategic support to the Chief Justice in the administration of the Judiciary. At all times, the priority of the Judiciary Administration is in furthering the interests of the Judiciary and the administration of justice in Hong Kong.
More specifically, the JA is responsible to the Chief Justice for the following areas –
(1) Safeguarding the institutional independence of the Judiciary in the administration of justice in the HKSAR;
(2) Advising the Chief Justice in relation to the administration of the Judiciary;
(3) Being the head of the Judiciary Administration –
(a) To ensure that proper support is provided to the judges in the administration of justice;
(b) To effect the proper administration and management of all the offices and units under the Judiciary Administration, thereby ensuring the proper functioning of the Judiciary, including the smooth operation of judicial proceedings at all levels of courts;
(c) To develop policies, procedures and practices to enhance quality in the administration of justice;
(d) To ensure there is optimal management of resources, including financial, personnel and accommodation, in support of the effective administration of the Judiciary;
(e) To maintain and develop appropriate and effective communications between the Judiciary and all its stakeholders, including the community;
(f) To maintain and develop exchanges between the Hong Kong Judiciary and its counterparts in other jurisdictions;
(4) Acting as the key liaison person in dealing with the executive and legislative branches of the Government; and
(5) Serving as the Secretary to the Judicial Officers Recommendation Commission, which is the statutory body responsible for making recommendations to the Chief Executive on judicial appointments and matters related thereto.
福利包括例假及度假旅費津貼、醫療及牙科診療、房屋福利(須受有關的公務員事務規例訂明的申領準則規限),及其他與這職位相稱的福利。受聘人將受《強制性公積金計劃條例》(第485章)規管,並須向強制性公積金(下稱「強積金」)計劃作出僱員方面的供款。
在合約圓滿結束後,受聘人可獲約滿酬金。該筆酬金,連同政府向強積金計劃所作的供款,相等於合約期內擔任上述職位所得基本薪金總額的15%。
申請人於獲聘時須為香港特別行政區永久性居民,並具備下列條件︰
(1) 持有由本港大學頒授的學士學位或同等學歷(法律學位並非必要;具香港司法及法律制度經驗並對這些制度有充份認識的申請人會有優勢);
(2) 精通中英雙語;及
(3) 擁有大規模公營、私營或非牟利機構高層行政及管理職位的經驗。
以下為司法機構政務長職位所要求的素質︰
(1) 作為支援終審法院首席法官管理司法機構的最高級行政人員,司法機構政務長須對法治精神及司法獨立有透徹的認識。他/她亦須對執行司法工作、司法機構運作、司法機構與其主要持份者(尤其是政府行政及立法機關)的聯繫及香港和其他司法管轄區司法機關的相互關係有良好的認識;
(2) 作為終審法院首席法官管理司法機構的主要顧問,司法機構政務長必須廉潔守正,並具備卓越的分析能力、優良的判斷力及前瞻性的視野;
(3) 作為司法機構政務處之首,司法機構政務長應具備豐富的管理經驗和熟練的行政技巧,並有能力作出富策略和創意的規劃及按終審法院首席法官指示落實計劃;及
(4) 作為司法機構的主要行政人員,司法機構政務長須能與法官和職員衷誠合作,並具備良好的人際溝通及領導技巧。
Candidates must be permanent residents of the HKSAR at the time of appointment and should have –
(1) a bachelor’s degree from a Hong Kong university, or equivalent. (A legal degree is not essential. Possession of experience and a good understanding of the operation of the judicial and legal system in Hong Kong will be an advantage);
(2) a strong command of English and Chinese; and
(3) experience of holding a senior administrative and managerial position in a sizeable organisation in the public, private or non-profit making sectors.
Candidates should bear in mind the following qualities expected of the Judiciary Administrator (JA) –
(1) As the most senior administrator who supports the Chief Justice in the administration of the Judiciary, the JA must have a thorough understanding of the concept of the rule of law and the independence of the Judiciary. He/She must also have a good understanding of the administration of justice, the operational aspects of the Judiciary, the interface between the Judiciary and its key stakeholders (in particular the executive and legislative branches of the Government) and the interface between the Hong Kong Judiciary and its counterparts in other jurisdictions;
(2) As a key adviser to the Chief Justice on the administration of the Judiciary, the JA must be an individual of high integrity and should possess strong analytical skills, sound judgement and foresight;
(3) As the head of the Judiciary Administration, the JA should possess considerable management experience and solid administrative skills, and the ability both to plan strategically and innovatively and to execute plans as directed by the Chief Justice; and
(4) As a key administrative personnel in the Judiciary, the JA must be able to work well with both the judges and the staff. This includes the possession of good communication, inter-personal and leadership skills.
基本法知識評核 – 為提高大眾對《基本法》的認知和在社區推廣學習《基本法》的風氣,政府會測試應徵公務員職位(包括司法機構政務長職位)人士的《基本法》知識。申請人在基本法測試的表現會佔其整體表現的一個適當比重。
獲取錄的申請人將按公務員合約條款聘任,為期三年,政府可酌情決定續聘。
(a) 公務員職位是公務員編制內的職位。應徵者如獲聘用,將按公務員聘用條款和服務條件聘用,並成為公務員。
(b) 作為提供平等就業機會的僱主,政府致力消除在就業方面的歧視。所有符合基本入職條件的人士,不論其殘疾、性別、婚姻狀況、懷孕、年齡、家庭崗位、性傾向和種族,均可申請本欄內的職位。

(d) 如果符合訂明入職條件的申請人人數眾多,司法機構可以訂立篩選準則,甄選條件較佳的申請人,以便進一步處理。在此情況下,只有獲篩選的申請人會獲邀參加面試。

(f) 持有本港以外學府頒授的學歷人士亦可申請,惟其學歷必須經過評審以確定是否與職位所要求的本地學歷水平相若。有關申請人須於2019年10月25日或之前(以郵戳日期為準)把修業成績副本及證書副本郵寄到「申請手續」部分所列明的地址。

申請人如獲約見,通常會在截止申請日期後八個星期內接到通知。如申請人未獲邀參加面試,則可視作經已落選。為避免郵件過期或未能成功派遞,在投寄前請確保信封面已清楚寫上正確地址及已貼上足夠郵資。所有郵資不足的郵件將不會派遞至司法機構,並會由香港郵政按情況退還寄件人或銷毀。申請人須自行承擔因未有支付足夠郵資而引致的任何後果。
