職責
將派往律政司憲制及政策事務科轄下中國法律組工作。視乎律政司工作需要,工作範圍預期包括:
(a) 就內地法律問題進行研究,並草擬英文(或如有需要時草擬中文)研究報告或意見書;
(b) 就香港與內地之間訂立的諒解備忘錄草擬稿或合作安排草擬稿提供法律意見;
(c) 為在香港和內地舉辦或安排宣傳活動,工作坊,研討會,探訪,培訓項目等提供支援;
(d) 在前往內地探訪及從內地來香港探訪方面提供支援,包括草擬雙語摘要、背景文件、簡報,演講要點和演講稿;
(e) 就內地當局向香港提出的合作計劃草擬稿提供法律意見;以及
(f) 執行不時獲派的其他工作。

To be deployed to the China Law Unit in the Constitutional and Policy Affairs Division. Subject to the Department’s operational needs, the postholder is expected to engage in the following areas of work –
(a) To conduct research and prepare research notes or draft advice in English (or, when so required, in Chinese) on Mainland law issues;
(b) To provide legal input on draft memorandum of understanding or draft cooperative arrangements to be entered into between Hong Kong and the Mainland;
(c) To provide support in organising or arranging promotional events, workshops, seminars, visits, training programmes, etc., both in Hong Kong and the Mainland;
(d) To provide support in relation to visits to and from the Mainland which includes the preparation of draft bilingual briefs, background paper, powerpoints, speaking points and speeches;
(e) To provide legal input on draft cooperative initiatives proposed by Mainland authorities with Hong Kong; and
(f) To undertake such other duties as may be assigned from time to time.

入職條件

(a) 須已通過國家統一法律職業資格考試或國家統一司法考試,以及取得國家統一法律職業資格證書或國家統一司法考試合格證書;
(b) 須持有法律學士學位;
(c) 須在綜合招聘考試的英文運用試卷考獲“二級”成績及中文運用試卷考獲“一級”成績。就此,香港中學文憑考試英國語文科第5級或以上成績;或香港高級程度會考英語運用科C級或以上成績;或General Certificate of Education (Advanced Level) English Language科C級或以上成績,會獲接納為等同綜合招聘考試英文運用試卷的“二級”成績。此外,申請人如在International English Language Testing System (IELTS)學術模式整體分級取得6.5或以上,並在同一次考試中各項個別分級取得不低於6的成績,在該IELTS考試成績的兩年有效期內,其IELTS成績即視為符合本職位有關英文能力的入職要求。IELTS考試成績必須在職位申請期內其中任何一日仍然有效。另外,香港中學文憑考試中國語文科第4級成績;或香港高級程度會考中國語文及文化、中國語言文學或中國語文科D級的成績,會獲接納為等同綜合招聘考試中文運用試卷的“一級”成績。未有取得所需綜合招聘考試成績但符合其他入職條件的人士,亦可提出申請。他們必須在2021年6月25日或之前已在英文運用試卷取得‘二級’成績和在中文運用試卷取得‘一級’成績,方會獲聘。於獲聘時未有取得綜合招聘考試中文運用試卷“一級”成績的申請人亦可能獲聘,視乎律政司工作需要;
(d) 有以下專業經驗更佳:在香港或《律政人員條例》(第87章) 第2A條及附表2所規定的任何一個認可司法管轄區內取得律師資格後,具備最少三年專業經驗;或在香港或《律政人員條例》(第87章)第2A條及附表2所規定的任何一個認可司法管轄區內取得大律師資格和全面執業權後,具備最少四年專業經驗;或為根據《法律執業者條例》(第159章)註冊的外地律師,並在香港或其他地方具備最少三年專業經驗;以及
(e) 具備最少三年內地律師專業經驗的內地律師執業證書的持有者更佳。

Candidates –
(a) must have passed the National Unified Legal Professional Qualification Examination or the former National Unified Judicial Examination and obtained the certificate for the National Unified Legal Professional Qualification or the certificate of competency for the National Unified Judicial Examination;
(b) must have a bachelor’s degree in law;
(c) must have ‘Level 2’ result in the Use of English paper and ‘Level 1’ result in the Use of Chinese paper in the Common Recruitment Examination (CRE). In this connection, Level 5 or above in English Language of the Hong Kong Diploma of Secondary Education Examination (HKDSEE); or Grade C or above in Use of English of the Hong Kong Advanced Level Examination (HKALE); or Grade C or above in English Language of the General Certificate of Education (Advanced Level) are accepted as equivalent to ‘Level 2’ in the Use of English paper of the CRE. Further, candidates with an overall band of 6.5 or above with no subtest score below band 6 obtained in the same sitting in the Academic Module of the International English Language Testing System (IELTS) within the two-year validity period of the test is considered as having met the English language proficiency requirement of this post. The IELTS test result must be valid on any date during the application period. Besides, Level 4 in Chinese Language of the HKDSEE; or Grade D in Chinese Language and Culture or Chinese Language and Literature of the HKALE are accepted as equivalent to ‘Level 1’ in the Use of Chinese paper of the CRE. Candidates without the requisite CRE results but who have met the other entry requirements may also apply. Appointment will be subject to their obtaining ‘Level 2’ in the Use of English paper and ‘Level 1’ in the Use of Chinese paper of the CRE on or before 25 June 2021. Candidates who do not have Level 1 in the Use of Chinese paper of the CRE by the time of appointment may also be appointed subject to the operational needs of the Department;
(d) should preferably have the following professional experience: be a solicitor with at least three years’ professional experience since admission in Hong Kong or in any one of the recognised jurisdictions as stipulated in Section 2A and Schedule 2 of the Legal Officers Ordinance (Cap. 87); or a barrister with at least four years’ professional experience since attaining the right to full practice in Hong Kong or in any one of the recognised jurisdictions as stipulated in Section 2A and Schedule 2 of the Legal Officers Ordinance (Cap. 87); or a foreign lawyer registered under the Legal Practitioners Ordinance (Cap. 159) with at least three years’ professional experience in Hong Kong or elsewhere; and
(e) should preferably have been a holder of a Mainland lawyer’s practice certificate with at least three years’ professional experience as a Mainland lawyer.
