職責
高級律師主要負責知識產權法律工作,包括制定政策及法例﹔商標、專利及外觀設計的註册﹔準司法審裁聆訊﹔向政府部門及決策局提供民事法律諮詢服務﹔以及向公眾推廣知識產權。
A Senior Solicitor is mainly deployed on intellectual property legal work relating to policy formulation and law-making, registration of trademarks, patents and designs, quasi-judicial tribunal hearings, civil legal advisory services to government departments and bureaux and public education.
入職條件
申請人必須—
(a)(i)在《律政人員條例》第2A條及附表2所規定的認可司法區內取得律師資格後具備五年專業經驗﹔或
(ii)在《律政人員條例》第2A條及附表2所規定的認可司法區內取得大律師資格和全面執業權後,具備六年專業經驗﹔以及
(b)符合語文能力的要求,即在綜合招聘考試的英文運用試卷取得“二級”成績,以及在中文運用試卷取得“一級”成績[註(1)],或具備同等成績[註(2)]。申請人未有取得所需的綜合招聘考試中文運用試卷的“一級”成績,但在香港中學文憑試或香港中學會考中國語文科取得第2等級的成績或以上[註(3)],或具備同等成績,亦可提出申請。
註:
(1)綜合招聘考試中文運用及英文運用試卷的成績分為“二級”、“一級”或“不及格”,並以“二級”為最高等級。
(2)香港高級程度會考英語運用科C級或以上和D級的成績,會分別獲接納為等同綜合招聘考試英文運用試卷的“二級”和“一級”成績。香港高級程度會考中國語文及文化、中國語言文學或中國語文科C級或以上和D級的成績,會分別獲接納為等同綜合招聘考試中文運用試卷的“二級”和“一級”成績。General Certificate of Education (Advanced Level) English Language科「C」級或以上的成績會獲接納為等同綜合招聘考試英文運用試卷的「二級」成績。在International English Language Testing System (IELTS)學術模式整體分級取得6.5或以上,並在同一次考試中各項個別分級取得不低於6的成績的人士,在IELTS考試成績的兩年有效期內,會視為已符合高級律師職位的英文語文能力(即入職條件的(b)項)。IELTS考試成績必須在職位開始接受申請的首天(即2014年2月28日)仍然有效。
(3)政府在聘任公務員時,過往香港中學會考中國語文科E級的成績,在行政上會被視為等同2007年及以後香港中學會考中國語文科第2等級的成績。
(4)為提高大眾對《基本法》的認知和在社區推廣學習《基本法》的風氣,所有公務員職位的招聘,均會包括《基本法》知識的評核。申請人在基本法測試(學位/專業程度職系)的表現,會用作評核其整體表現的其中一個考慮因素,但不會影響其申請公務員的資格。原則上,申請人的學歷、經驗和才能仍然是考慮其是否適合被聘用的主要因素。
Candidates must -
(a)(i) be solicitors with at least 5 years’ professional experience since admission in a recognized jurisdiction as stipulated under Section 2A and Schedule 2 of the Legal Officers Ordinance; or
(ii) be barristers with at least 6 years’ professional experience after attaining the right to full practice in a recognized jurisdiction as stipulated under Section 2A and Schedule 2 of the Legal Officers Ordinance; and
(b) have met the language proficiency requirements of ‘Level 2’ result in the Use of English paper and ‘Level 1’ result in the Use of Chinese paper in the Common Recruitment Examination (CRE) [Note (1)], or equivalent [Note (2)]. Candidates who do not have ‘Level 1’ result in the CRE Use of Chinese paper but have attained Level 2 or above in Chinese Language in the Hong Kong Diploma of Secondary Education Examination (HKDSEE) or Hong Kong Certificate of Education Examination (HKCEE) [Note (3)], or equivalent, may also apply.
Notes:
(1) Candidates’ results of the Use of Chinese (UC) and Use of English (UE) papers are classified as ‘Level 2’, ‘Level 1’ or ‘Fail’, with ‘Level 2’ being the highest.
(2) Grade ‘C’ or above and Grade ‘D’ in Use of English of the Hong Kong Advanced Level Examination (HKALE) are accepted as equivalent to ‘Level 2’ and ‘Level 1’ results respectively in the UE paper of the CRE. ‘Grade C’ or above and ‘Grade D’ in Chinese Language and Culture or Chinese Language and Literature of the HKALE are accepted as equivalent to ‘Level 2’ and ‘Level 1’ results respectively in the UC paper of the CRE. Grade ‘C’ or above in English Language of the General Certificate of Education (Advanced Level) is accepted as equivalent to ‘Level 2’ in the UE paper in the CRE. Applicants with an overall band of 6.5 or above with no subtest score below band 6 obtained in the same sitting in the Academic Module of the International English Language Testing System (IELTS) within the two-year validity period of the test is considered as having met the English language proficiency requirement of the Senior Solicitor post. The IELTS test result must be valid on the starting day of the application period, i.e. 28 February 2014.
(3) For civil service appointment purpose, ‘Grade E’ in Chinese Language in previous HKCEE is accepted administratively as comparable to ‘Level 2’ in Chinese Language in the 2007 HKCEE and thereafter.
(4) For the purpose of heightening public awareness of the Basic Law (BL) and promoting a culture of learning of BL in the community, assessment of BL knowledge will be included in the recruitment of all civil service jobs. Results of the BL test for degree/professional grades will be one of the considerations to assess the suitability of a candidate but will not affect his/her eligibility for applying for civil service jobs. As a general principle, the main consideration for suitability for appointment remains a candidate’s qualification, experience and calibre.
